DiCello Levitt Partner Named to Plaintiffs’ Executive Committee and Appointed Co-Chair of Law & Briefing in Lawsuit Over Slowed-Down iPhones
United States District Court Judge Edward J. Davila of the Northern District of California appointed DiCello Levitt partner Amy E. Keller to the Plaintiffs’ Executive Committee and as Co-Chair of Law & Briefing in In re: Apple Inc. Device Performance Litigation. In her role, Ms. Keller will oversee briefing and strategy related to complex legal issues in a class action brought against Apple Inc. by consumers in every state and territory in the United States, as well as consumers in other countries.
Dozens of lawsuits were brought against Apple concerning updates to its mobile operating system (iOS), which allegedly included code that significantly reduced the speed and performance of millions of iPhones, forcing many consumers to spend hundreds of dollars to replace those devices and batteries. The lawsuits have been consolidated before Judge Davila, and are proceeding in a consolidated fashion.
“This is a significant lawsuit involving a necessary consumer good: the cell phone,” Ms. Keller noted. “Consumers pay hundreds of dollars for devices that have become integrated into our daily lives. With probes against Apple for ‘planned obsolescence’ related to the allegations in our lawsuit, this case will impact consumer choice, and whether companies can use technology to push new products on the public in the future.”
The case is In re: Apple Inc. Device Performance Litigation, No. 18-md-02827-EJD, pending in the United States District Court for the Northern District of California.
